As we advised in our April 22, 2024 Summary of the 2024 Housing Laws on April 20, 2024, the Good Cause Eviction Law (“GCE”) was enacted. Pursuant to the new Real Property Law (“RPL”) §231-c, landlords are required to append or incorporate a “Good Cause Eviction Law Notice” (the “GCE Notice”) with every:
- Initial lease,
- Renewal lease,
- Notice of rent increase or nonrenewal pursuant to RPL §226-c(1),
- Statutory 14-day rent demand pursuant to Real Actions and Proceeding Law (“RPAPL”) §711(2), and
- Petition pursuant to RPAPL § 741.
The requirement to append or incorporate the GCE Notice takes effect on August 18, 2024. A copy of the GCE Notice can be found here. The language of the notice is statutory and should not be modified or amended. The relevant apartment information should be completed on the first page of the GCE Notice. In Section 1, the landlord must indicate whether the apartment is or is not subject to GCE. If the apartment is exempt from GCE, the landlord should complete Section 2 by marking all applicable exemptions and for initial or renewal leases, check option B in Section 4. For apartments exempt from GCE, the landlord does not have to complete Sections 3 of the GCE Notice. If the Apartment is subject to GCE, the landlord should skip Section 2 and complete Sections 3 and 4 by marking the applicable responses.
In the event that a tenant’s lease term has expired, or a tenant has been served with a notice of termination or notice of nonrenewal, please contact us before accepting any rent payments (whether by check, money order, wire, payment portal, ACH, and/or other electronic means).
