Commercial Litigation

• Achieved favorable settlement on behalf of CEO/founder of tech startup in corporate governance dispute with other founders in Delaware Chancery Court, securing exclusive control of company for client, and robust IP, non-compete, and non-solicitation protections.
• Achieved favorable settlement on behalf of international art curator in breach of contract dispute relating to Banksy art exhibition in Los Angeles after filing for emergency injunctive relief in California State Superior Court.
• Prevailed at trial on hospital-client's counterclaims against former management company in commercial dispute, resulting in multi-million-dollar damages award on counterclaims and denial of recovery for plaintiff.
• Won emergency motion for TRO and preliminary injunction on behalf of construction factoring firm in lawsuit against construction subcontractor in New York State Supreme Court, New York County.
• Successfully defended media production and distribution companies in commercial and employment dispute with former executive employee.
• Leveraged pre-judgment attachment to obtain a full recovery in a dispute over leases worth tens of millions of dollars where the guarantor was a foreign conglomerate and the lessor was in bankruptcy.
• Obtained complete dismissal of claims against pharmaceutical company arising from a patent license royalty dispute.
• Represented developer of luxury condominium units in seeking specific performance of purchase and sale agreement concerning a property valued at nearly $200 million.

Securities Litigation

• Won motion to dismiss on behalf of all defendants in civil Rule 10b-5 action filed by institutional investor in federal district court in San Jose, California, against a private media company and two of its officers.
• Secured a favorable settlement for foreign telecom company in government investigations and a securities class action in California arising from disclosures about company's capital expenditures.

White-Collar Defense

• Successfully defended Mexican national in a criminal money laundering investigation brought by the U.S. Attorney's Office for the Southern District of New York laying the groundwork for dismissal of the indictment and release of millions of dollars in assets seized for forfeiture.
• Represented criminal defendant in appeal to the Second Circuit of conviction in Southern District of New York on securities and wire fraud charges. Successfully maintained defendant on bail while appeal was pending and defeated government's motion to remand defendant to prison.
• Successfully convinced U.S. Attorney's Office for the Southern District of New York to not pursue charges against bank employee under investigation in insider trading case.
