R&E Member Arielle Frost moderated the fourth panel, “Filling the Capital Stack: Creative Joint Ventures to Close Deals,” at Bisnow’s NYC State of the Market event on November 15, 2022. The panel addressed how increasingly creative uses and structuring of joint ventures are trending in today’s state of the market, particularly in light of the decrease in financing available from traditional lenders. Arielle, who specializes in joint venture transactions, discussed how different preferred equity structures are being implemented, the increased use of co-GP and co-Sponsor joint ventures, and how exit strategies and dispute resolution mechanisms are currently being addressed in joint ventures. The panel also discussed the various ways in which today’s state of the market has caused developers and investors to shift their investment strategies, including changes in capital sourcing, the asset classes they are pursuing, and even their target geographical area for new projects.
