Rosenberg & Estis was a proud sponsor of the Anchin Construction & Development Forum on February 9, 2017. R&E Member Richard L. Sussman participated as a panelist to discuss construction and development activity in and around NYC, including the prospects for the next few years and trends affecting the marketplace for office, residential retail and hotel development. The recent past has seen an historic high in construction and development, pushing costs for land and labor to all-time highs. However, with a glut in luxury condos, contraction of office requirements, a changing retail landscape, higher barriers to construction financing, and the lack of 421-a tax abatements, the industry needs to prepare itself for the demands of a changed environment and a possible slowdown once the current pipeline of projects come to completion. The panelists discussed how we mitigate the challenges that this topsy-turvy market brings. Among other topics, Sussman's panel (entitled "The State of the Market for Construction & Development") discussed different trends that have been observed with new construction, including how lifestyle changes affect construction in the workplace and residential settings. In one example, Sussman noted that both new/redesigned residential and office space is consciously being designed to foster an "environment of accidental collisions", meaning that the construction or lay out of the space is meant to create and foster and encourage interactions among people. Along with the concept of a collaborative setting, there are also trends of reducing private individual space and in office space, having a higher density of desks and empty desks so as to allow for future growth in a cost efficient manner.

When Luise A. Barrack-seen here with Lightstone Group acquisitions and development director Meir Milgraum at ICSC in Las Vegas-left the District Attorney's office, she was looking for a practice area that was both challenging and evolving. She found it in real estate when she joined Rosenberg & Estis, where she has built relationships with clients and colleagues, helping to make the firm seamless, collaborative and more successful. This collaboration is incredibly important, she says, as "the labyrinth of local rent regulatory laws" present a huge challenge to the industry. Until recently, many of these laws did not apply to commercial properties. However, she explains, the City Council passed a bill into law intended to protect commercial tenants against "harassment"-effective Sept. 28-which, in many ways, places commercial property owners in the same position as residential property owners. Luise believes that working hard and putting "everything you have into what you do" is the key to success. And, if you need to clear your mind and get some exercise, you can join a bike club and go on long-distance bike trips, as she does.

Bradley discussed a variety of issues relating to reasonable accommodation requests involving animals in residential buildings (public, private, condo, and cooperative units). The discussions centered on the changes in the Rent Act of 2015 which extended the rent laws until 2019. The recent amendments increased the threshold for high rent vacancy, high income/high rent deregulation, added indexing to these deregulation thresholds, and modified the vacancy allowances permitted for apartments leased with a preferential rent. Also addressed were the changes in the language of the statute which has created confusion about whether an owner can include legally permitted increases to the legal rent subsequent to vacancy in order to bring the rent of the vacant apartment above the deregulation threshold or whether the apartment had to be above the legal deregulation threshold prior to vacancy for the apartment to be deregulated.

The Young Jewish Professionals organization is a group focused on improving and expanding the social and professional lives of young Jewish professionals. The YJP provides business networking, mentoring sessions and social opportunities for the new generation of Jewish business leaders.

A veritable who's who of the NYC real estate community attended the annual gala for chashama. Since 1995 chashama has been connecting artists with temporary exhibition spaces in transitioning New York real estate. This year's annual gala, the organizations 20th , was held in the Conde Nast Building in the Frank Gehry designed dining hall, and featured installations from over 30 artists that chashama supports.
Rosenberg & Estis P.C. attendees included Luise Barrack, Jason Davidson, Warren Estis, Robert Kessler, Joshua Kopelowitz, Michael Lefkowitz, Larry Mergentime, Blaine Schwadel and Richard Sussman.
The evening honored Barbara and Donald Tober, leaders in supporting the arts. Barbara is the Chairman Emerita of the Museum of Arts and Design and Donald is the Chairman and CEO of Sugar Foods Corporation.
