John B. Acierno III joined Rosenberg & Estis, P.C. in 2016 as an associate with the firm’s Transactional Department.  Mr. Acierno’s practice involves representing lenders in all types of real estate related financings, including senior mortgage, construction financing, preferred equity and mezzanine lending. Mr. Acierno also has extensive experience in counseling financial institutions on a variety of bankruptcy issues, including motions for relief from automatic stay, objections to plan confirmation, cash collateral and post-petition financing issues, valuation hearings, non-discharge ability actions, preference litigation and acquisition of loans in bulk.

 

Notable Work

 

         Represented an EB-5 lender in a $200 million junior mezzanine loan transaction for the construction of a multi-use project in Times Square, New York

         Represented the agent in a $95 million syndicated construction loan for a global delivery services company in New York City.

         Represented the lender in a $20 million transaction for the acquisition of an apartment complex in Mesa, Arizona.

         Represented the lender in a $29 million transaction for the acquisition of land and construction of a multi-use retail and apartment complex in the Orlando, Florida area. 

         Represented the agent in a $70 million syndicated transaction for the construction of an outlet center on Indian Tribal Land that connects two casinos in Connecticut.

         Represented the lender in a $50 million revolving line of credit secured by a pool of real property located across the United States.

         Represented the agent in a $77 million syndicated transaction for the construction of a multi-use project in Lexington, Kentucky.

Mr. Acierno received a bachelor's degree, magna cum laude, from Wheeling Jesuit University and achieved his J.D. from Duquesne University School of Law. Mr. Acierno earned his Masters of Law degree in business and corporate law from University of San Diego School of Law.  Mr. Acierno is a member of the California State Bar Association, the Pennsylvania State Bar Association, the Utah State Bar Associate and the New Jersey State Bar Association.  Mr. Acierno is licensed to practice law in California, Utah, Pennsylvania and New Jersey.

 

Prior to joining Rosenberg & Estis, Mr. Acierno served as a Real Estate Associate with Buchanan Ingersoll & Rooney, PC.
